What is Community Property?

Community property includes all property, assets and debts that were acquired during the course of the marriage. Inheritance, gifts and property owned by the spouse prior to the marriage are considered separate property and generally excluded from property division.

Community property can include the following:

  • Marital homes
  • Vehicles
  • Family farms
  • Family businesses
  • Livestock and crops
  • 401(K)s
  • Bank accounts

The court will divide the community property in a “just and right” manner. However, this does not necessarily mean a 50-50 split. The court may consider a variety of factors when making the division, including who has primary custody of the children and the earning capacity of each spouse, among others. One of our primary goals is to make sure that our clients are treated fairly by the system without accumulating unnecessary litigation costs.

At Sullivan & Cook, LLC, we believe that an informed and well-advised client is able to make better decisions about his or her future. To that end, we always take the time to explain the marital property division process, answer all questions, and address any anxiety on the part of a client.

Business Valuation

Our attorneys have extensive business backgrounds, making them particularly effective when business valuations must be undertaken. In an effort to ensure our clients obtain their fair share, we use experts and private detectives to uncover hidden assets. Our objective is to make sure that all property, income and pensions are included in calculations of marital property.
