What is Community Property?

Community property includes all property, assets and debts that were acquired during the course of the marriage. Inheritance, gifts and property owned by the spouse prior to the marriage are considered separate property and generally excluded from property division.

Community property can include the following:

  • Family businesses
  • Livestock and crops
  • 401(K)s
  • Bank accounts

The court will divide the community property in a “just and right” manner. However, this does not necessarily mean a 50-50 split. The court may consider a variety of factors when making the division, including who has primary custody of the children and the earning capacity of each spouse, among others.
